Fine Penalty Of Corporate Crimes

The increasingly severe situation of the offences by corporation has aroused attention of the whole society. Fine penalty in the concerned problem, however,is relatively weak. How to apply fine penalty properly and combat corporate crimes effectively is a crucial matter. Dispite the difficulty of having insufficient ready-made academic data,this paper has consulted large quantities of documents on fine penalty and corporate crimes. It addresses the relation of these two issues and makes a comparative study of relevant systems in China and foreign countries from both theorietical and practical inspectives. This paper comprises the following 4 chapters. Chapter 1 expounds the relation of fine penalty and corporate crimes and reveals the importance and the unique of fine penalty through analysing the historical evolution and present utilization. Chapter 2 discussed throughly the principle of fine penalty applied to orporate crimes and dissects the legislative defects of fine penalty to be directed against the important function of fine penalty on remedying the corporate crimes by punishment. Chapter 3 expresses the author's opinion on the principle of dealing with corporate properties in relation to disposal of other properties. It further expounds that the difficulties of execution lies in the existed legislative defects after analyzing the characteristics of corporate properties. Chapter 4 inquires into the improvement of the punishment system by putting forword the specific suggestion. The core is to add penalty on corporate crimes on the basis of perfecting fine penalty to discipline corporate crimes effectively.
