Laborers' Collective Bargaining Right

What this paper studied is the laborers' collective bargaining right. Due to the particular economy transformation, now the relation between labor and capital in our country is becoming more and more complicated. With putting forward and implementation of advocacy of laborers' right in international trade, how to protect laborers' rights and interests has attained more attention of our government day by day. However, the situation of protecting the laborers' rights and interests in our country has still failed up to expectations. There are a lot of reasons for this, for example, it is not strict in enforcing the law. But in the author's opinion, legislation is the key point, that is, the law is not perfect. The relevant regulations of the labor law are either scarce, or fail to " keep pace with the time", or, the current labor laws and regulations are not coherent enough, sometimes even go so far to be contradictory ——This paper has made analysis to these questions one by one.The author analyzes collective bargaining right by combining the history and reality, and attempts to do some deep studies to the current situation (especially current legislation situation) of the collective bargaining right in our country by comparing the international conventions and the measures adopted by developed countries with Chinese regulations and rules concerned, in the hope of inspecting weak points and finding out some measures to solve these problems that still exist in the current laws of China.The main view of this paper is: Only when the laborers have legal collective bargaining right, and fully exercise this right, could they protect their own work rights and interests effectively; For realization of their collective bargaining right, laborers also should be authorized with freedom of association, freedom of expression and legal right to strike. Also, the outstanding characteristic (or call it the " innovating point " ) of this paper lies in launching an overall exposition of collective bargaining right from the aspect of analyzing the relations between the laborers' collective bargaining right and freedom of association, speech and strike. The author has put forward some unique opinions in this paper on it.
