In October, 2003, Premier Wen JiaBao took back defaulted salaries for a Peasant-worker during his survey in Chongqing. Since then the problem about defaulted salaries for Peasant-workers are focused on all over the country, which was mentioned in particular by Premier Wen in his Government work Report to National People's Congress in 2004. This not only shows that CPC and government are concerned about Peasant-works and with their salaries in arrears, but also reveals the severity of such problem. Peasant-workers' rights to salaries should be protected by laws and institutions. This paper at first defines the conception of Peasant-worker, and then analyzes theoretically the problems of legal protection of Peasant-workers' rights to salaries after discussing the reasons for such problem in details. In the end this paper upholds strongly such idea that Constitution and other concerned laws should be enacted in time according to the special situation of our country, and by using foreign experiences of labor legislation for reference.
