Research On The Legal System Of Maintaining Peasant-worker Rights And Interests

Peasant -worker is the special group in China. Its appearance is inevitable. The peasant-worker, which is temporary and transitional, is the special community on specific historical period. The peasant-worker is one of the most important strengths in the process of modernization. They have been influencing our country economy and society development. Maintaining their rights and interests has the great practical and historical significance. But the present legal system has many insufficiencies, and the peasant-worker rights and interests usually couldn't be protected, so the system urgently wants to be consummated.To establish the maintaining law system of peasant-worker rights and interests, we limit the"peasant-worker"scope in legal at first, and then analyze the peasant-worker's present situation and the correlation legislation. On these basis, we propose to establish "one organization" (peasant-worker management association), "two networks" (a city-countryside social security net, peasant-worker information management network) as the core to construct the law institutional framework of maintaining peasant-worker rights and interests. To protect the peasant-worker's rights and interests, we must establish the comprehensive management and the macroeconomic regulation control system for the peasant-worker flowing. By these means, we may make the city- countryside and various industrial departments develop harmoniously.
