Protection Of The Chinese Land System By Criminal Law

Land is one of the basic production material; land system is the most basic social system. Land is considered as limited resource. Therefore, It is our duty to protect Land system and land resource. Land system has political character; land damage seriously undermine social order and has other social consequence. These factors make it necessary of introdction of criminal law into land system. This article starts with protection of land resource, protection of land system by criminal law, refer to land system criminal law in different countries, focus on the analysis and suggestion of protection of the Chinese land system by criminal law.In chapter one, The history of Chinese land system was summarized in the periods such as federalism, semifederalism-semicolonism, new china area, and in the Taiwan region. Other countries's land system and related criminal laws are also analyzed. By comparing Chinese land system and criminal laws with other countries'; The development pattern of land system and criminal law are pointed out. In chapter two, Our current land system and its protection are summarized. The necessity and rational of land system to be protected by criminal law are pointed out. Also in this chapter, the concept and characters of criminality in land system are explained. Chapter three and four then detail the pertinent legal provisions defining four classes of crimes in land system. There four classes are then separated into on duty and not on duty crimes. The concept of each criminal act, crimination and criminal penalty are analyzed and suggested. In chapter five, further law making in land system are suggested.
