Reseach On Our China’s Criminal Law Protection Of Food Safety

In recent years, our country’s credit business is developing fast. The lightweightcharacteristics of credit card brings people a lot of convenience, and without carryinglarge amounts of cash, people can undertake consumption. Meanwhile, the overdrawsfunction of credit card makes people be able to buy things when they do not haveenough money at the right moment, and this can cater the demand of modern people’sconsumption habbit. However, more and more disputes have been coming out, and allsorts of legal problems also increasingly exposed. The rapid development of creditcard requires a relatively perfect legal system.Food safety threatens our people’s health and life safety,and food safety isrelated to our country ’s economic development and social stability,also,food safetyproblem restricts our country ’s foreign trade.In addition,the requirements of foodsafety property,food enterprises’ characteristics and Criminal Law’s mandatory andfunction,all of them ask for the Criminal Law protection.From the relevant provisions in our China’s criminal law,there are threecategories related to food safety crime:First,the crime of production andoperation;Second,the crime of illegal management;Finally,the crime of food safetyregulation.The Criminal Law plays a certain role in the specification on the producersand sellers’ behavior,but there are still many defects:The cohesion between the laws isnot enough;The legal provisions have some loophole;The food safety crime isclassified incorrectly;The specific norms are set unsoundly.In view of the defects of our China’s Criminal Law protection of foodsafety,combined with some good practices of western developed countries,I give somesuggestions to make up the deficiency of our China’s Criminal Law protection of foodsafety:Strengthen the cohesion between food safety laws and regulations;Add therelevant food safety crime into the Criminal Law;Cancel the legislation of dangerouscrime;Increase the penalty of confiscation of property;Adjustment the finepenalty;Add the Qualification penalty,etc..
