An Observation On People's Supervisor System

The people's supervisor system is an important reform in China's procuratorial organ. It means an external supervision from the public on the cases that the procuratorial organ hears and investigates directly. Because it is a new system, the theory basis is weak. It has been proposed in about ten provinces in China from August 2003. To get a good effect, the Supreme People's Procurator has drawn up the proposed regulations for the experiment. Not only the government but also the public is concerned about the experiment of the people's supervisor system. Though the range of the experiment has been extended, we can see following problems: the conflict of supervision time, the conflict between the idea and limitation of supervision, the conflict between supervision procedure and criminal procedure. All those problems should be solved by the amendments of the law. The first part of this paper is about the background, the necessity and the value of the people's supervisor system. The second part of the paper is about the reality of the people's supervisor system through the proposed regulations. The last part of the paper is about the drawbacks of the system and the advice for its reform.
