Study On The History Of CPC's Thought Of Being In Power By Law

From analyzing the academic circle's studies about being in power by law since the 16th National Congress of CPC, I find that those studies just concentrate on the current situation and the future of the CPC's being power by law, but also the contents of their studies are only about the importance of being in power by law or suggestions how to do it, while there are seldom studies about the history of the CPC's being power by law. But history tells us that there were thoughts on CPC's being in power by law, although it was difficult for the Communist Party of China to be in power by law because of the influence of a series of factors. To make people know the history of CPC's being power more clearly and completely, this article will investigate the history of CPC's being power and analyze how the CPC think about the relation between the CPC and the law, the CPC and state apparatus, and then tell the readers the progress of the development of the CPC's thought of being power by law.Now, we can conclude that it has gone through the stages as follow that the development of CPC's thought of being in power by law, the embryonic stage in the revolutionary period, the beginning stage in the early days of the People's Republic of China, the frustration stage during the twenty years from 1957 to 1977, the establishment stage in Deng Xiaoping's period, the systematization and practice stage from Jiang Zemin's period till now. In the five stages above, the last tow stages are the most important ones. In 1982, the 12th National Congress of CPC promulgated the new party constitution with a regulation of "the party must do anything without being against the Constitution and law ", and in the same year, the fifth meeting of the five session National People's Preventative Conference promulgated the New Constitution which stipulated that all political parties in China "must all regard constitution as basic activity criterion ", " must observe the Constitution and law ", they indicate that the CPC's thought of being in power by law has established from then on. " "Run a Country By Law" was established as the CPC's basic strategy for running the country in 1997 and "Being in Power By Law " was formally put forward in 2002, such tow things means separately that the CPC's thought of being in power by law was systematized and began to be completely put into practice. Finally, this articlegets an answer that it's a certain result from history that the CPC's choose "Being in Power By Law" as the main way of being in power by comparing and analyzing carefully the development of each stage of the CPC's thought of being in power by law.In this article, I used such writing methods as history narrating, comparing and analyzing and so on, I compared and analyzed any stage with other one before it while narrating the content of the CPC's thought of being in power by law in that stage, and concluded the characteristics of every stages. In addition, I also used the dialectical analytic approach in this article, while paying attention to the success of each stage I analyzed the deficiency existed at that time and what coursed it. After all, I paid close attention to the frustration stage and the reasons why the CPC's thought of being in power may encounter the frustration during that stage.
