Research On Legal Restriction Of Administrative Power

With the development of society, the power that the administrative organ has been provided with expands day by day. Under the influence of various kinds of factors, if this kind of administrative power can't be restricted effectively, it will be out of control and bring great danger to the legitimate interests of citizen, legal person and other social organization. It is indispensable to restrict the administrative power effectively for advancing administration by law and building socialist country governed by law. In order to guarantee the honest, just, rational operation of administrative power and ensure the realization of government governed by law in ten years in our country, we need to restrict the administrative power further from the administrative power subject, the administrative legislation, administrative law enforcement, administrative procedure, supervision by legal system, etc on the existing basis. This dissertation has utilized the basic principle of Marxism--the research approach that the theory combines with practice. With the system method as the guideline, it makes every effort to put forward the newer and more feasible legal system for the restriction of the administrative power in our country. In order to seek the available approach that will execute the administrative power normally, this dissertation has studied the subject on legal restriction of administrative power systematically, analyzed the outstanding problems existed to the restriction of present administrative power in our country scientifically, used basic theories principle of administrative law synthetically, and then put forward to the concrete measures that will strengthen the legal restriction of administrative power.
