Research On Countermeasures Of Antidumping Against China Based On WTO AD Agreement

Based on the WTO Anti-Dumping Agreement and major procedures, this thesis combines the current situation which foreign countries launch against Chinese export products, by means of the analysis of economic motivation of enterprises' dumping behaviors and the different economic benefits for the two verdicts, in order to help enterprises avoid these antidumping restrictions in their international trade. The chief countermeasure to the prosecution of antidumping is divided into three stages: the first stage is that enterprises could choose the best one from three price strategies and should make the effective anti-dumping alarm at the same time; the second stage is that, once there are foreign antidumping procedures against China, the export enterprises should take active price undertaking according to foreign antidumping laws and procedures in order to protect their legitimate export rights and interests; the third stage, enterprises can make good use of the WTO dispute settlement mechanism, expedited review, annual administrative review, judicial review and sunset review to diminish the antidumping loss as early as possible. This research into the countermeasures of antidumping against China will be of great help to the export enterprises, not only to maintain and increase their foreign market proportion, but also to help them better understand the free trade in modern market economy. In addition, it makes sense practically and theoretically in nurturing the competitive idea and increasing the status of export enterprises after the entry into WTO.
