Construction Of Criminal Procedural Judicial Review System

Judicial review principle has become an international procedure principle, namely the court make the national peremptory power perform the active role, to check the legality of it, to protect the individual legal right avoiding the illegal invasion of national peremptory power.Criminal procedural judicial review refers to the review on illegal behavior according to procedure. It determines the realization degree of the purpose directly; purpose is criminal procedure protect-right. However at present law system there are some phenomena which are against the judicial review principle, for example the lack of judicial power previous criminal, no one pay attention to the procedural illegal behavior during the process of judgment. All these cause that the purpose of protect right in criminal procedure can not realize completely. This paper will based on the basic theory to analyze the specific construct of criminal procedural judicial review system in Chain, the most important in it is the whole procedural construct of system.
