At the 30's of the 20th century, western countries first proposed organic agriculture. The basic idea of organic agriculture is to protect the environment and realizing sustainable development of agriculture.Organic farming has both ecological benefit and economical benefit and social benefit in versatility. Relative to the organic agriculture in western countries for farmers, awareness of environmental protection and the origin of organic agriculture in China is mainly in international trade development, which as well as impetus of the development process and so on, to export organic products breakthrough green barriers, the development of organic agriculture became, in addition, the consumers' cognitive level is not high, to organic products in "eat more at ease" level, to play the role of organic agricultural environmental protection and localization market development value. Next, put in environmental view some countermeasures of organic agriculture, institutionalization, can make legalization of organic agriculture in sustainable development is the fundamental guarantee. Therefore, establishing a perfect legal system of organic agriculture is imperative. Based on the necessity of organic agriculture and theoretical basis,also on the basis of the interpretation of organic agriculture system at home and abroad are in no condition reviewed, and it also puts forward the suggestion of organic agriculture system.
