A Comparative Study On The Legal System Of Organic Agriculture

Over the past two decades,China through the ecological agriculture and green food development work,some new technologies continue to produce and promote,but also for the development of modern organic agriculture to provide a reliable technical support.It can be said that China's organic agriculture is in line with the trend of international organic agriculture development,in line with China's national conditions.Moreover,organic agriculture can fundamentally reduce the negative externalities of agricultural production to the environment,and it emphasizes the principles of ecology and health,and if it is ideal for practice,it is conducive to the protection of biodiversity.This paper focuses on solving the problem of collecting domestic and foreign organic agriculture legislation,the development trend and the practical case of local agriculture development after legislation.Through the empirical case to improve the combination of China's socialist national conditions of sustainable development support the development of organic agriculture legal system.Specific research includes five main aspects:In the first part,the purpose,background and significance of this research are put forward.The second part is the research situation at home and abroad.The third part summarizes the legal system of organic agriculture in developed countries.The fourth part summarizes the practical problems of the legal system of organic agriculture in China.The fifth part puts forward the improvement measures of the legal system of organic agriculture in China.Finally,through the study,the following conclusions:First,China's organic agriculture legal system and the development of foreign agricultural legal system is different:(1)China's organic agriculture product standards are not comprehensive,different from the United States,the European Union's comprehensive standard content system.The United States,the EU based on the organic agriculture industry chain is divided into production,processing,sales and logo four management system to form the rules or additional rules of the implementation of standards.(2)China's organic agriculture product sales channels and Japan is different.Japan's organic agricultural products production and marketing channels more extensive and diversified,and China's organic agricultural product sales channels also need to further expand and form a standardized management of the legal system.Second,China's organic agriculture legal system and foreign legal system have figured out:(1)organic agricultural products logo requirements and the EU,the United States,Japan is roughly the same;organic certification procedures,China and the European Union,the United States,Japan is roughly the same.Third,the correct face of China's organic agriculture legal system exists the practical problems: China's organic agriculture legal system lack of cultural connotation;China's organic agriculture legal system there are legislative defects;China's organic agriculture legal system is not international standards;China's organic agriculture legal system exists management Defects;China's organic agriculture legal system lack of production and marketing management.Put forward specific solutions:(1)to create a modern organic agriculture cultural connotation of the legal system,from the organic agriculture support system,organic agriculture science and technology system system two aspects.(2)to build an international legal system of organic agriculture.(3)to adapt to the new situation of agricultural legislation urgent follow up.(4)improve the organic agriculture management system.(5)the implementation of agricultural products production and marketing channel system.
