Research On The Legal Issues Of Bankruptcy On Ship Management Company

With the arrival of financial crisis, the ship management companies in China are also facing pressure of bankruptcies. The particularity of the property constitution of the ship management companies leads to the particularity of their bankruptcy property and bankruptcy claims. And all of this has led to the large number of contradictions in the liquidation sequence of the ship management companies'claims in bankruptcies.After simple analysis of the situation of the ship management companies in China, The paper discusses the particularity mentioned above in 3 sections: The first part studies bankruptcy debts of the ship management companies; it analyzes the constitutional range of them, classifies their bankruptcy debts in connection with the features of the companies, and raises limits of bankruptcy debts of the companies on the basis of this.The second part studies bankruptcy property of ship management companies, definitions their bankruptcy property mainly theoretically and on the basis of legal practices, analyzes the retake rights of the ships under the management of the companies, and relative rights of their overseas property are also studied in this part.The third part studies payment sequence of the ship management companies'claims in bankruptcies. In this part, the contradictions in the bankrupt liquidation sequence are firstly pointed out, then principles to solve these contradictions are raised, and solutions are raised under the principles.
