On Realization Of The Managerial Rights For Rural Land Contract

The reform of rural land system influences the whole political and academic fields. In other words, the success of the rural land reform directly relates to the success of socialism with Chinese characteristics. Many scholars study the reform of rural land system from economic, political, legal fields, etc.In terms of the legal field, the managerial rights of the rural land contract are mostly discussed from the perspectives of property ownership and property law by means of economic law and civil law.However, many researches are not based on such China's traditional cultural background as the big government and small society, devoid of the influence by the executive power on the managerial rights of the rural land contract. In fact, under the present situation of China, system reform bearing national hope, the realization of the managerial rights of the rural land contract is not only economic issue.This paper will analyze from the actual dilemma of the managerial rights of the rural land contract on the basis of related theoretical analysis and critical review of the aggression of the administrative authority on the managerial rights of the rural land contract, and exploring the excellent balance between the administrative authority on the managerial rights of the rural land contract by the means of constitutional and administrative law and in macroscopic perspective restricting the government power and protecting people's rights and taking the suitable steps.
