The View In Judicial Expertise Of Procuratorial Organs Of Our Courtry

Judicial expertise system as a part of lawsuit system, could provide scientific evidences for perplexing litigious activities, and should never be ignored in judicial system. With the deepening reform of judicature in China, the expertise system gradually appears to be unaccommodated with aims of litigation value and the development of evidence system. It has aroused widespread concern that all kinds of disadvantages greatly damage the seriousness of expertise, and also go against the justice and efficiency of aims of litigation value, which are pursued by judicial reform in our country. As a supervisory authority of national law, procuratorial organs assume important responsibilities in maintaining the uniform and correct implementation of laws and guaranteeing the fairness and justice in the whole society. Meanwhile, procuratorail organ, an entity having judicial expertise rights, faces some following questions: whether the existence of judicial expertise rights is necessary; how to accurately perform judicial expertise rights; how to improve the judicial expertise systems, herein the author would like to give some points of view based on the discussions of many other researchers.
