A Study On The Application Of The Bona Fide Acquisition Of Real Estate

The implementation of the Property Law indicates that our country first establishes the system of the Bona Fide Acquisition of Real Estate in the form of the Basic Law. The provisions of the Property Law related to the Bona Fide Acquisition of Real Estate plays a significant part in directing judicial practice in our country, which, nevertheless, put much emphasis on principles. It is especially pointed out that the provisions of the Property Law synthetically stipulate the procurement of the movable and immovable properties in good faith, simplify the components of the procurement in good faith and meanwhile conceal the difference in the components of procurement of movable and immovable properties, thus making it inevitable that conflicts often appear in judicial practice.Therefore, the author of the thesis selected the typically encountered case in trial review to explore the application of the Bona Fide Acquisition of Real Estate. The thesis mainly analysed the explication of the components of procuring immovable property in good faith, unauthorized disposition of validity of transfer contract and other issues. It was mentioned that the thesis clearly made a distinction between the components of procurement of movable and immovable properties and exactly defined unauthorized disposition of validity of contract to properly apply and improve the system of the Bona Fide Acquisition of Real Estate. Meanwhile, it was also pointed out that the thesis paid close attention to the proper balance and the connection between the system of the Bona Fide Acquisition of Real Estate and the relevant legal systems, sought to establish the perfect registration system and embodied public credibility of immovable property registration. Based on the content above, the thesis aimed to explain and apply the Bona Fide Acquisition of Real Estate in practice and improve it constantly in legislation.
