Research on the conflicts and coordination between WTO multilateral trading system and regional trade agreements has been a hot issue in the field of WTO law and international trade law in recent years. Based on the extensive utilization of related domestic and foreign achievements, this paper makes a further theoretical exploration of conflicts between WTO multilateral trading system and regional trade agreements. Under a precondition that the relationship between WTO multilateral trading system and regional trade agreements should be defined in a parallel relationship which complements each other, it discusses the coordination between them, and also China's strategy of participating in and building regional trade agreements in terms of mitigating and solving conflicts.This paper macroscopically describes the developing status and the future trend of the WTO multilateral trading system and regional trade agreements. Based on this, it also concludes and summarizes the conflicts between the WTO multilateral trading system and regional trade agreements, in combination with the achievement gained by domestic and foreign scholars. Besides of this, the paper also explores the coordinated development of the both in terms of mitigating and solving conflicts. In addition, this paper analyzes and makes a research on China's strategy in the further participation in and construction of regional trade agreements, which is on the basis of a background of trying to get coordinated development between WTO multilateral trading system and regional trade agreements, and a target that not only promoting the coordinated development between WTO multilateral trading system and regional trade agreements, but also well catching China's economic development opportunities brought by regional trade agreements development.In the first chapter, this paper summarizes the current state of development of WTO multilateral trading system and regional trade agreements, and analyzes the prospects for the development of both WTO multilateral trading system and regional trade agreements with consideration of the future development trend of global economy; it also points out that WTO multilateral trading system and regional trade agreements are essential for rapid and healthy development of global economy.In the second chapter, this paper sums up the conflict and impact between WTO multilateral trading system and regional trade agreements from two aspects, i.e. "regional trade agreements impacts and challenges WTO multilateral trading system "and "WTO multilateral trading system affects regional trade agreements". Then, it analyzes the causes of the conflict and effects, as well as the affects, which are brought by the conflicts, on the global trade development and on their own respective development.In the third chapter, this paper defines the relationship between WTO multilateral trading system and regional trade agreements as a complementary parallel one, and discusses the methods for coordinating the conflict between them. It also creatively rises up an idea of building an international coordination system choice which can surpass the WTO multilateral trading system and regional trade agreements. The chapter also stressed that, as a trading power, China should fully understand their own part and role in the international trade order, and accordingly actively participates in WTO multilateral trading system and regional trade agreements coordination.In the last chapter, this paper sums up the current status of China's participation and contribution to the regional trade agreements. It also analyzes the coordination of the conflict between regional trade agreements which China is participating in and building, and the WTO multilateral trading system. Furthermore, it puts forward a number of strategies for China to further participate in and build regional trade agreements. For example, China should adhere to the route of "from home to abroad, from near to far, from one point to the whole ", to develop regional trade agreements; also, China should continue to strengthen the construction and use of CEPA, etc. |
