Research On The Legal Regulations Of RTAs Coordinating The Conflicts Between Trade And Environmental Protection

Environmental issues have attracted much attention since they entered people’s perspective in the 1970 s.More and more multilateral environmental agreements have been reached internationally for different environmental fields.Some of these rules have either raised the market entry threshold or caused differences in competitiveness,hindering international trade liberalization,and between environmental protection and international trade.The contradictions have become increasingly prominent.Multilateral trade rules with the purpose of promoting international trade liberalization and multilateral environmental agreements with the goal of protecting the environment cannot balance trade and environmental issues.Regional trade agreements have advantages in coordinating conflicts between trade and environmental protection.The article aims to rationalize the relationship between trade and environmental protection through the study of the EU trade agreement and the environmental rules in the US-Mexico-Canada Agreement,and to make recommendations for the sustainable development of trade and the environment.This thesis aims to analyze the legal conflicts between trade and environmental protection,and discuss the coordination path between trade and environmental protection laws,and point out the advantages of regional trade agreements to coordinate the conflicts between trade and environmental protection.Secondly,studying the coordination of trade and environmental protection in the EU trade agreement,a comprehensive environmental law and policy have been formed within the EU.At the same time,the negotiations and formulation of multilateral environmental agreements have been actively promoted,and multilateral environmental agreements have been integrated into regional trade agreements to promote the promotion of their environment Will’s International Strategy.Third,study the environmental chapter clauses of the US-Mexico-Canada Agreement,which incorporates the environmental rules of the North American Free Trade Agreement and the Trans-Pacific Partnership Agreement,and adopts a multi-stakeholder management model when coordinating trade and environmental protection conflicts Substantive rules covering multiple environmental issues,as well as mature dispute settlement mechanisms,reflect the higher standards of environmental rules in regional trade agreements.Finally,the article based on a comparative study of the EU trade agreement and the US-Mexico-Canada Agreement to coordinate trade and environmental protection conflict rules,combined with China’s actual development,puts forward suggestions to improve China’s free trade agreement.
