Study Of Relevant Issues On China General Average Regime

This paper consists of four chapters with 13 sections. According to the 'York—Antwerp Rules, 2004', it attempts to have a general research on the development of common loss in the future. Try to study on our general average system superficially, and then put forward a sound proposal.This article begins the first chapter with a brief introduction on the concept of general average,the legal nature of general average and the history of our general average system.Then the second chapter introducs the general average system in detail, including the history of general average system in our country and the existing laws and common rules of the general average.the third chapter gives a general presentation for the'York—Antwerp Rules, 2004', trying to sort out the development path of the general average system, since ancient times. Through the above research, the paper cues to the 'York—Antwerp Rules,'and gets ready for the developing tendency on our system of general average. Based on the research on the revision reason, revision context, revision assessment, the meaning and impact of'the rules of Yorkshire-York-Antwerp', the 'York—Ant-werp Rules, 2004'is good for the general average System of China as a direction. the 'York—Antwerp Rules, 2004'not only has the common places with the old one, but also presents some fairness and the beneficial balance; at the same time, it is good for increasing the economic efficiency and plays as a new direction.Meanwhile, in the fourth chapter the paper points out the deficiency and the defects of our general average system. then,the paper makes a comprehensive proposal to our general average system, which is an important part of the article. Through the above study on the 'York—Antwerp Rules, 2004'and the analysis on the inadequacies of our general average system, the author put a complete set of views on general average, so that our general average system and the international system with the general average unanimously.
