Brief Discussion The Civil Law Protection Of The Commercialization Rights

Name, image, reputation, honor, and other spiritual elements are essential elements of the full moral rights. With the development and progress of society and market economy, the economic value of some personality rights of natural persons (legal persons) is more important. Its commercialization has become the inevitable trend. As a"new"right uprising, the range of the commercialization rights is constantly expanding, and leads to an important and far-reaching impact on the protection of the personality right. However, our existing laws protecting the right of commercialization have some flaws and shortcomings. We shall take more complete and strong legal protection measures to protect the right of commercialization to face its economic activity in the market .Only by doing this ,on one hand ,we can defend the basic human dignity, on the other hand , we can meet the desire of civil person to protect their personal economic interests effectively. Indeed, the protection for the commercialization of the personality can and should be diversified, but the author thinks the main method of protection should be the protection by civil law and other laws as the supplement methods. This paper starts from the civil law protection of the commercialization rights so as to focus on the discussion of the methods of protecting the commercialization rights.
