With the popularity of computer and network technology, the new interpersonal relationships and e-commerce based on the network have been emerged in our present society. As rapid development of the existence and access of electronic information, the challenge was existed for the legal worker to obtain the research evidence and evidence legislation, which will lead to a new chance for criminal offense. In recent years, the cyber crime based on computer network is quickly emerged.The location and consequence of cyber crime often at different place, and the lagging legal system, without obvious objective trace and evidence,it will be very difficult for us to obtain the criminal investigation and evidence. So, the electronic evidence in criminal will play an invaluable role at this time. Meanwhile, it will be a new subject for us to investigate and confirm the criminal electronic evidence.At present, there are some problems in our present legal system. Such as, without appropriate and sturdy legal protections for electronic evidence, identification and collection, security mechanism, and lacking of high-tech knowledge for the judicial officers, inappropriate accreditation system and authentication of electronic evidence, and so on. In this paper, we defined the electronic evidence in criminal identification, and analyzed the rules of criminal electronic evidence. Learning the successful experiences in abroad and transforming them to localization by comparative analysis and empirical research methods, we developed some new rules for computer crimes and electronic evidence in criminal identification, and made rules can be integrated into the world norms. And we established identification of criminal organizations electronic evidence laboratory, and solved the related issues encountered in practice and new legal issues from the technological development.
