The Research On Law System Of The Environmental Audit

With the rapid development of economy, Chinese have being paid more attention to the efficiency of enterprises and their economic interests since reform and opening-up. However, regardless of environment, it has taught people a profound lesson that ignoring the ecological resources. Ignoring environment protection caused many serious pollution accidents and undermined environment quality. In the industrial cities, there are land pollution, noise pollution, water contamination and acid rain such as London.Enterprise and construction project are not only the core and foundations of economic development, but also the focus of environmental problems. The conventional view is that human need inexhaustible resources. The investment in environmental protection will increase the cost of the production and operation, then aggravate burden of enterprise. For this reason, the focus of enterprises and government is not environmental benefits, but short-term economic benefits. It is important how to plan environmental development direction and the process. Besides, it has become the key to realize the objective of sustainable development that standardizes the social members and enterprise environmental behavior. As an important system of environmental protection, the environment audit is significant in Supervising and directing environmental behavior of enterprises.In theoretical research, our current research of this aspect is still quite unsystematic, and there is a long way from the developed countries such as Europe and America. In our country, there are only some essays of this topic published, but no systematical monograph on the topic or related issues. Therefore, the further research on the environmental audit law system is of certain theoretical significance. In addition, there is not complete law system of the environmental audit, though it has taken us lots of attemptation in legal practice. As a result, to analyze and perfect the system of Environmental law from the environmental audit law system is of positive and practical significance.Based on the concept , forms and features of environmental audit, this article analyzes the challenges confront traditional environmental law and new theories put forward internationally, together with Chinese judicial practice,so as to accumulate experience to solve this problem that how to perfect our environmental audit law system.The full text is divided into five parts except the foreword and conclusion. The first part starts from concept of environmental audit, mainly talking about its Basic theoretical issues, such as meaning, characteristics and kind. In the second part, the author introduces several theory prompted the emergence and development of environmental audit. The third part is on experience of foreign environment audit legislation and regulatory. The fourth part analyses the current situation of environmental audit legal system. In part five, the author, on the basis of content introduced in the fourth part, gives advices on the construction and improvement of law system of the environmental audit.
