| Using legal means or quasi-legal means to solve sports disputes is a sign marking human sport activity moving towards legalization. With the internationalization and commercialization of the human sport activity, there are more and more various kinds of sports disputes include transnational sports disputes. How to direct against the proper settlement mechanism of particularity setting-up of different sports dispute, it is an important problem that the law circle faces. Through constant practical explorations, various countries have accumulated very abundant experiences and quite valuable measures, of which sports arbitration is one of the most effectual and extensively-used measures. But any systems concerned about sports arbitration have not yet really been established in our country so far, which can not meet the development of international situation. This paper attempts to probe into basic theoretical problems in Chinese sports arbitration system, and to do some exploratory studies on the legislation of the Sports Law and the establishment of Chinese sports arbitration system.
