On The Scope Of Application Of Sports Arbitration In China

Although the system of sports arbitration in China has not been established yet,the discussion of the sports arbitration system has not stopped since the promulgation of the sports law.The reason is our country sports and competitive sports development has not yet reached the advanced level,but with the development of China's sports undertakings,figure in the international sports arena are frequent,the disputes emerge in an endless stream.As for the settlement mechanism of disputes in the sports arbitration section,there are no specific laws and regulations,only reflected in the "sports law".The purpose of this paper is to discuss the scope of the application of sports arbitration under the sports arbitration system,starting with the sports arbitration system in China.First of all,the specific analysis of sports disputes and sports dispute settlement mechanism,and thus lead to the necessity of the establishment of sports arbitration system.Secondly,it makes a comparative analysis from the international sports arbitration and the scope of the application of international sports arbitration.Finally,the scope of the application of sports arbitration in China is discussed,and the case types of the applicable scope of the sports arbitration in China are obtained.This article mainly uses the comparative research method,the speculative method,the literature survey method,the qualitative analysis method to carry on the research of the thesis.The comparative analysis method has been used many times to compare the scope of application of international sports arbitration with the applicable scope of sports arbitration in China.It is specifically about the analysis of the disputes of sports principles,and the scope of our sports principles and how to apply them.This paper compares civil and commercial arbitration,labor arbitration and sports arbitration,discusses the necessity of the establishment of sports arbitration and the specific matters applicable to the scope of sports arbitration.The sports arbitration applied in this paper is as follows:(1)all disputes in competitive sports,but excluding sports criminal disputes and sports administrative disputes;(two)disputes about sports principles;(three)disputes about sports technical rules.
