A Study On Initiative Procedure Of Criminal Investigation On Defalcation And Bribe

Investigation on corruptions is one of the important parts of the criminal investigation. It differs greatly from the investigation of common crimes. Whether the procedure of investigation starts in time and in effect means much. There exists some limitations and puzzles in the current procedure of criminal investigation on defalcation and bribe at present. So it is necessary to improve the procedure of criminal investigation on defalcation and bribe. In this thesis, the author's purpose is to advance the capability of the investigators.The thesis is divided into six parts.Chapter one is about the initiative procedure of criminal investigation on defalcation and bribe at present. It consists of three facets: impeaching, preliminary investigation and filing the case.In chapter two, author first introduces extra-territorial initiative procedure of criminal investigation on common crimes, analyses the similarities and differences of the two investigation modes. Then author introduces the three representative institutions which investigate the defalcation and bribe.Chapter three is about the limitations of practice in the initiative procedure of criminal investigation on defalcation and bribe at present. The distribution of the clue, the investigators'power and the occasion of filing the case are discussed in this chapter. Chapter four is about the puzzles of theory in the initiative procedure of criminal investigation on defalcation and bribe at present. The law basis and character of the preliminary investigation, the effectiveness of the evidence which is collected are discussed in this chapter.In chapter five, some specific ideas are put forward to improve the initiative procedure of criminal investigation on defalcation and bribe. The institutions which investigate the defalcation and bribe should build up the notion that the investigation is active and energetic.In chapter six, some further ideas are put forward to improve the initiative procedure of criminal investigation on defalcation and bribe. Collecting information actively, coercive measures, technical measures and cases in series are discussed in this chapter.
