Research On Limitation Of Liability Of Convention On Bunker Oil Pollution Damage 2001

The implementation of the Bunker Convention played a positive role on limitation of liability for Bunker Oil Pollution Damage. But inevitably there are some problems in the convention, particularly the problem on limitation liability. Though the convention appears to maintain the systems of limitation of liability in forces of its parties, in fact, it does not play a role, On the contrary, the inadequate of marine compulsory liability insurance of the convention makes this problem even more complex.. This paper mainly analyses the question of the inadequate of the convention from angle of limitation of liability, and proposes the solution. This paper includes three parts.The first part mainly discusses the basic provisions of the Convention. The second part discusses the problems of the Convention, and the influence on limitation of liability. The third part discusses the problem on Limitation of Liability influences compulsory liability insurance. The fourth part discusses establishment of an fund for compensation for bunker oil pollution to make up for the inadequate of the convention. In the fifth part, the current situation in respect of enforcement of the convention is analyzed primarily, and take example by Jiangsu province to analyze how to implement compulsory liability insurance of bunker oil pollution damage.
