The establishment of 2001 "International Convention on Civil Liability for bunker pollution damage" (hereinafter referred to the Bunker Convention ) is to reduce and control the marine environment pollution ,it provides a compensation mechanism for bunker pollution damage to the marine environment .The reasons to develop such an international Bunker Convention, are that there are lack of a compensation legislation for bunker pollution damage in the international society, and this kind of pollution damage, even a small amount of ordinary bunker fuel, is quite large and would incur high level of clean-up costs. With Bunker Convention coming into force in the upcoming November 21, 2008 , it will fill the last gap in the international oil compensation system which is to pay the victims of the ship oil spills and damage ,the Bunker Convention is applied mainly to the civil liability for pollution damage and compensation liability caused by fuel leak from the ship Fuel compartment . And the current international compensation system is only for the pollution damage by oil tankers.This paper analyses the main features of the Bunker Convention by introducing background and the content of the Bunker Convention, and the problems which the Bunker Convention may be encountered, the prospects of the Bunker Convention and the role or the position in the development of the international Shipping Civil Liability for Oil Pollution Damage compensation mechanism, then discusses whether China enters the Bunker Convention, to tally with the international Convention. And brings forward some views and opinions on the establishment of China Shipping Compensation for Oil Pollution Damage mechanisms.
