As the computer-network technology is booming, the network society has been emerging as a unique form of society which is different from the real society. In China, the network has become an important engine to propel the development of economy and society. In the flourishing network revolution, cyber-criminal activities are increasingly rampant. People's legitimate rights can't be safeguarded, so the appeal for criminal regulation on cybercrimes is rising.The norms on cybercrimes in current PRC Criminal Law are only stipulated in Article 285 to 287, and they are only on computer system crimes and committing crimes by using computers. Both the crime descriptions and the listing of the penalty types can not meet the needs of the development of the network society. Starting with the concepts and characteristics of cybercrimes, this paper classifies cybercrimes into typical and non-typical ones, and then illustrates the defects of China's criminal regulation on cybercrimes, and on this basis draws reference from the Convention on Cybercrime and explores the improvement on the current cybercrime system of China.
