Research On Jurisdiction Of Bankruptcy Cases

In this paper studies the jurisdiction of bankruptcy cases, from the perspective of comparative law and the jurisdiction of the objections. This article firstly analyzes jurisdiction of the bankruptcy cases from the depth of the general theory leading to bankruptcy case legal values, and then under the jurisdiction of bankruptcy cases, proposes to improve the bankruptcy case under the jurisdiction of several ideas. In accordance with the discussion of the logical system, this article consists of four chapters, major elements as followed:Chapter one is mainly from a theoretical perspective and a broad definition to explain definition of the jurisdiction of bankruptcy cases, content, history and legal values.Chapter Two,from the perspective theory,analyzes mechanism governing the operation of bankruptcy cases, and identified criteria.Chapter Three,mainly from comparative perspective,separately researches the jurisdiction of the bankruptcy case and jurisdiction objections.The author closely tracks the latest theoretical achievements and latest legislative situation,and then obtains understanding and enlightenment.Chapter Four puts forward some perfect suggestions on the jurisdiction of the bankruptcy case on the basis of Chapter Two and Chapter Three.
