Humanmedizin Experiment is an experimental behaviour imposed on human body by using medicines, medical apparatus and instruments and new medical technology. It's purpose is to develop new medicine (including vaccine), improve medical technology (including gene therapy) and build up more medical science knowledge. With fast development of medical science technology, people pay more attention to the value of Humanmedizin Experiment; meanwhile, we should not ignore the legal interests and human rights protection of experiment subjects (including patients). We must face up to the existing problems which happened in the process of Humanmedizin Experiment. Interests balance between the researcher and the patient is a serious problem which should be treated well. This article is written to discuss and analyse the legal features, present situation, existing problems and law regulations of Humanmedizin Experiment along with according solutions.This article can be divided into four parts besides Introduction and Epilogue. Part One defines Humanmedizin Experiment, analyses its characteristics and reviews its history. Part Two discusses the legal character of Humanmedizin Experiment from two aspects of civil law and criminal law, clarifies the researcher's duty and the patient's interests. Part Three compares international laws and laws in developed countries, shows the current situation of Humanmedizin Experiment in China and existing problems in legislation and practising. Part Four presents ideas that how to solve problem of Humanmedizin Experiment in China from three aspects of tort law, administrative law and criminal law.
