The Research On Antimonopoly Law's Regulation Of Trade Association's Competition-limited Behavior

The trade associations are the nongovernmental organizations which are nonprofit,autonomy and intermediary composed by undertaking of the same industry, it plays important positive role in the market economic system; As it plays positive role to promote the healthy development of the industry; but it maybe potential menace public interest as a tool to implement the competition-limited behavior, so the trade associations are regulated by antimonopoly law of each country in the world.With the gradual improvement of China's market-law of economic system, regulating competition-limited behaviors of the trade association are put into our antimonopoly law. But the regulations in our antimonopoly law are simply, they cann't play actual role in regulating the trade associations'competition-limited behavior. As for it, the article attempt to do some research on how to perfect our antimonopoly to regulate the trade associations'competition-limited behavior by the center of the regulation in our antimonopoly law and from the viewpoint of the trade associations.The article firstly carried on defining the trade associations by comparing among the internal and foreign scholars'definition on the trade associations, classified the trade associations by reviewing the course of the trade associations, analyzed the characteristics;Then analyzed the positive and negative function of the trade associations in the market. Second is the analysis of the relationship between the trade association and competition-limited behavior. The second part specifically analyzes manifestations and causes of the restriction of competition of trade association. First is introduction of the six style of the competition-limited behavior, then analyzed the internal and outer causes of the trade associations'competition-limited behavior. The center of the third part is that foreign antimonopoly law. This part analyzed the regulation of trade associations'competition-limited behavior of foreign antimonopoly law and theoretically compared among them. On the basis of analysis and comparison, it investigates the reference the foreign experience. The fourth part is to the center of the competition-limited behavior of trade associations of our antimonopoly law's regulation It proposed an idea how to perfect our antimonopoly law to regulate the competition-limited behavior of trade associations by analyzing the legislative status and combining with the deficiency of our antimonopoly law, on legislative mode,the definition and range of the trade associations, legal liability and immunity system.
