Competition Law Perspective Industry Association Legal Regulation

As the establishment and improvement of Chinese socialist market economic system, trade association has presented itself as the deputy of the common interest for businesses of the same trade, and plays a more and more important role in the social development in China. On the view of the Competition Law, trade association seems to be a double-edged sword. On one side, trade association encourages competition; on the other side, it sets restrictions against free market competition by its inherent functions, and disturbs market economic order seriously. Thus it becomes the object of the Competition Law. However, the regulatory restrictions of the Competition Law system on the trade association's restrictive competition behavior are imperfect that will make some confusion and misunderstanding in the practices. So the article carried on the inspection to the foreign competition law which set regulations on the trade association's restrictive competition behavior and made the comparison between them, then we can absorb the useful legislative experience from them. Meanwhile we hope that we can give some practical and feasible comments and the suggestions for the Competition Law which set regulatory restrictions on the trade association's restrictive competition behavior on the basic of the legislative experience from the foreign countries.
