Research On Case Of Rights And Interests Protection Of Well-known Trademark

On 21st Aprile,2010,the Supreme People's Court issued "The Top 10 Cases of Protecting Intellectual Property Rights in the Chinese Courts" and one of the case on the list is "the BMW who sued the Century BMW had infringed its trade marks which was also unfair competition.Because the BMW is a famous global company and the trade mark of which is known by everybody,it was paid much attention by the public.This thesis analyses this case aiming at calling for the honesty and trustworthiness business ethics to prohibit the unfair competition and to protect the well-known trademark and famous firm name.The article is divided in four parts:The first part is to introduce the base case that the BMW sued the Century BMW and Jiaduorun Company and the trial in the court and to analyse the basic legal relationship and the main idea of judgement;The second part will talk about the relationship between the trademark and the firm name and also talk about the legal protection; The third part will point out and analyse the specialty of this case; And the last part will talk about the protection of the well-known trademark.
