The Research On The Formulation Of The System Of Elimination Of The Record Of Previous Crime

With the development of human rights, while scholars are turning their eyes on the profit protection of the people who had the record of previous crime, they find out many drawbacks of the system of the record of previous crime(hereinafter referred to as SRPC) gradually. In recent years, the SRPC has been paid great attention to. Among the current theory researches, we can see the call for the system of elimination of the record of previous crime (hereinafter referred to as SERPC). But a systematic discuss hasn't been developed and there is few researches on the SERPC. Therefore, it is essential to discuss and investigate, theoretically and thoroughly, how to build the SERPC, what kind of SERPC should be built, and what is the basis of the SERPC. In this thesis, started with the foundation of the SERPC, that is, the concept of the SERPC, and combined with the conditions of it, a series of basic theories are analyzed. Then, according to the current system of the criminal legislation in our country, and on the basis of analyzing the successful legislations in foreign countries, a preliminary design on the SERPC in our country is set up, so that, under the current legal system, a SERPC, which is in conformity with our national conditions, can be built, so as to promote the protection efforts of the interest of the people who had the record of previous crime.
