Study On Elimination System Of Previous Conviction

The elimination system of previous conviction is of great practical significance for the prevention of crimes and the promotion of resocialization of ex-offenders.Establishing an elimination system of previous conviction in accordance with China's judicial environment and social environment as soon as possible is not only an inevitable requirement for the modernization of criminal law,but also an appropriate choice under the criminal policy of temper justice of mercy.In the future,China's elimination system of previous conviction should first establish a registration mechanism for the unified management of criminal records,and then establish a criminal record inquiry mechanism to enable state organs,relevant units and individuals to query criminal records for specific purposes within the statutory period.Finally,a criminal record sealing mechanism should be established.After the statutory period,judicial organs should seal the criminal records of ex-offenders,and in principle,they should not provide them to any units or individuals,unless the state organs conduct inquiries based on judicial purposes or relevant units in accordance with the law.
