Study On Short-Term Prisonment Penalty And Socolisation Of Its Excution

Short-term prisonment penalty is a typical kind of freedom penalties, but with a relative short prison term. Comparing with other penalties, the short-term prisonment penalty has distinguishing value such as crime prevention; therefore it is unreasonable to simply repeal it. On the other hand, the socialisation of its execution is a beneficial way that could reduces its negative effects and keeps penalty system to be efficient. However, China is lagging behind on this issue. Against this background, this paper starts with examining whether it is possible to socialise the execution of short-term prisonment in China.In fact, practices regarding to this issue have already been in progress for several years in China which prove that the socialisation of its execution is feasible. However, it could not be ignored that there are some problems raised in such practices, and these problems are required to be solved. On basis of the above-mentioned facts, this article suggests that the current model of execution regarding to the short-term prisonment penalty may have to be reformed through improving its relevant legal provisions, establishing the system of community corrections, commuting imprisonment into other punishments and building criminal settlement framework.
