On The Institution Of Execution Of Penalty Imposed On Short-term Prisoners

In recent years, under the policy of light punishment and with the implementation of the revised Criminal Procedure Law of 2012, the proportion of short-term prisoners has been increasing among the prisoners. For the significant changes of constitution of prisoners, the challenge for prisons is becoming much greater. Exploring the theory of scientific execution and effectively reforming the short-term prisoners has become an urgent need to solve the problem of the current prison. Based on the legal practice, absorbing and profiting from effective experience and institution of execution of penalty on short-term prisoners of foreign countries, this thesis makes a theoretical exploration on institution of execution of penalty on short-term prisoners, trying to innovate traditional institution of execution of penalty on short-term prisoners, promote the reform of prison execution mode and construction of modern civilization.First of all, this thesis analyzes the short-term prisoners and institution of execution of penalty on short-term prisoners that clear the object of study. We studied the commitment of short-term prisoners, commutation, parole and other related execution system. Then we analyzed problems in institution of execution of penalty on short-term prisoners in our country. Such as the backward legislation, the imperfect system; the difficult implementation, the confliction between the system and the practice; the low commutation parole rate and etc. In addition,the thesis makes a comparative study of institution of execution of penalty on short-term prisoners between China and foreign countries in order to learn the experiences of advanced countries. Finally, the thesis give advices for perfecting the institution of execution of penalty on short-term prisoners:improving the law system of prison, setting up low security prison, constructing a new mode of parole based, supplemented by sentence, and increasing the non-imprisonment punishment, etc..
