Discusses The Consummation Of The Combining Administrative Enforcement And Criminal Justice

Mechanism combining administrative enforcement and criminal justice together has been raised for more than ten years since 2001. Work converging these two has carried out in the procuratorial organs in full swing in China, but the work had little further breakthrough. Currently, academics and practitioners has drew out consensus that administrative law and criminal law advocates comprehensive study although they are separate and distinct sub-area of the law. Studies from the establishment of mechanisms combining administrative enforcement and Criminal Justice, the examination of its implement in the latest 10 years has been done by lots of Scholars and practitioners of justice.This article attempts to explore the deep-seated reasons why administrative law enforcement and criminal justice can not be carried out, including deficiency in legislation and evaluation mechanism.The author is attempt to make clear the linking up of administrative law enforcement and criminal judicature through improving the convergence of the conventional operation of "two law"(joint research, joint meetings,...
