Studies On No-fixed-term Labor Contract

Labor contract is a written agreement negotiated by employees and employers to establish the labor relations and define the rights and obligations of both sides in the present market economy environment. It is conductive to promote economic development, safeguard the employee's legitimate rights and interests, mobilize the enthusiasm of workers and improve the economic interests of the employer. No-fixed-term Labor Contract, commonly adopted in Western countries, plays an active role in the establishment of stable labor relations and reduction of the unemployment rate. But in China, No-fixed-term Labor Contract, existing as a special Labor Contract, is more a welfare than a contract with some symbolism. January 1, 2008 "Labor Contract Law of the PRC" entered into force, which aims to enable No-fixed-term Labor Contract as the main form of employment by expanding the signing of No-fixed-term Labor Contract. But after implementation of nearly two years, rate of signing No-fixed-term Labor Contract is still very low. The employer still holds exclusive attitudes towards the No-fixed-term Labor Contract. So the implementation of the No-fixed-term Labor Contract is always in the low efficiency, which greatly effects the establishment of a harmonious and stable labor relations.This paper describes the present development of the No-fixed-term Labor Contract and analyzes the causes by introducing the evolution of the No-fixed-term Labor Contract in China. Consequently, Some measures are posed to improve the No-fixed-term Labor Contract, so as to make it the main Labor Contract in our country, promote co-development of enterprises and employees and construct harmonious and stable labor relations.
