On The Legislation Issues Of Homosexual Marriage

Not only in ancient times, but also in contemporary era, the homosexuality is being in our society. Reading from our history, people hold different opinions about it. Due to condition of a our country, many same-sex partners dare not stand for the point of view about their rights, even the marriage rights. Chinese people cannot understand the homosexual marriage because of their thoughts which effect on feudal culture. As a result, the same-sex partners have to conceal their sexual orientation, and their marriage rights cannot be came true. When the homosexual marriage become the hot topic in our society, protecting their rights is an important event. In the condition of lacking of legislation of homosexual marriage, it could lead to many society problems and so on. It goes without saying that legislating the homosexuality marriage for same-sex partner is becoming increasingly important and significant. One the other hand, stand for the point of view about their rights, even the marriage rights that could reflect the civilization level of one country. Legislating the rights of homosexuality marriage is necessary.Author insist that protecting the marriage rights for same-sex partner should be possible and valuable, or not people may hold some different attitudes, such as misunderstanding, disagree, even the opposites. The best way to solve these problems is legislation. Frankly speaking, we could protect the marriage rights of same-sex partner by the effect of law, leading, educating and regulating. That all goal is that our society becomes harmony.The thesis consists of six parts as follows:In the first part, this thesis introduces the basic development of homosexual marriage and same-sex partner, the basic researches about domestic research and overseas research, and the research methods for the thesis.In the second part, this thesis introduces the basic knowledge about the (?)ge, and the legislation of the rights of homosexual marriage. From this part, it could reflect the meanings, natures, features and so on.In the third part, this thesis introduces the homosexual marriage legislative mode of main countries. It contains Denmark, the Netherlands, Belgium, Spain, Canada, France, Germany, Switzerland, United Kingdom, United States and so on. Meanwhile, this thesis introduces different kinds of attitudes of experts.In the fourth part, author introduces all kinds of attitudes on same-sex-partner and homosexual marriage in our society. The aim is that educating people understand the same-sex partner and homosexual marriage.In the fifth part, author analyzes the possibility of legislating for same-sex-partner. It contains Law Ethics, Philosophy of Law, and Law culture. This thesis maintains that the homosexuality, homosexual marriage and the same-sex partner are non-pathological. People should show respect to the gay, and the law should protect their rights, especially the marriage rights.In the sixth part, this thesis introduces our country legislation on homosexual marriage, and draws blueprint or plan. Meanwhile, author gives some suggestions about legislation on homosexual marriage, the rights and obligations about the legislation on homosexual marriage. Author hopes that we must realize that we should put the homosexual marriage into the law.
