Research On Legal Regulation Of Same-sex Marriage

Since the emergence of human beings,homosexuality has been widespread.With the increasing social inclusion,the homosexual groups gradually emerge from behind the scenes in front of the public,and homosexuals especially appeal for the right to freedom of marriage.So same-sex marriage has become a problem we have to pay attention to.So far,many western countries have given homosexuals legal protection,and even some countries have given homosexual partners the right to civil union in various forms.Compared with foreign countries,the research on homosexuality in China(In this paper,China refers to the mainland of China,excluding Hong Kong,Macao and Taiwan,the same below)is still relatively simple.In our country,the homosexual population is still in a relatively marginal area.The position of the society and the government on homosexuality is exclusion and avoidance.In law,homosexual marriage is still not legitimate and lacks a series of legal regulations for this group.In summary,all kinds of motivations have contributed to this study.Starting from the protection of the rights and interests of homosexuals,this paper discusses the necessity and feasibility of the legal regulation of homosexuals and homosexual marriage in China by analyzing and comparing the current situation at home and abroad and relevant research results.Based on China's national conditions and current social conditions,this paper explores China's legal attitude towards the legal regulation of same-sex marriage,in order to seek the best coordination mode for the protection of the rights and interests of homosexuals and the current social situation.This paper mainly consists of three parts: introduction,body and conclusion.The introduction mainly introduces the research background,research significance,research status at home and abroad,research methods and research ideas.The main body is divided into five chapters.Firstly,it introduces the definition of homosexuality and homosexual marriage and its development history,leads to the object of this study,and establishes a macroscopic understanding of homosexuality in this paper.Secondly,it introduces the legal tradition of homosexuality in China and the existing situation of homosexuals,as well as the necessity and obstacles of legalization of homosexual marriage.Thirdly,through comparative study and literature research methods,this paper summarizes the foreign provisions concerning same-sex marriage legislation,trying to find a useful reference for the legislation related to same-sex marriage in China.Fourthly,on this basis,it demonstrates the legal basis of the legalization of same-sex marriage.Finally,by comparing the research results at home and abroad,this paper puts forward specific suggestions to improve the same-sex legislation in mainland China.The conclusion part is a summary of the full text.
