The Perfect Of Diverse Mediation System

Conflict is a state of confrontation . It will not only influence the interests of community members but also affect the social order and its stability. It is the duty of society managements to develop and perfect the system of conflicts resolution. Judicial approach might provide the most authority solution, but it is not rational or reality to put the duty of settling disputes on judicial system only. Mediation is an approach which settle disputes by reaching accord with the help of third party. Mediation get widely concerns because of its unique advantages, and it has been written in legal documents by many countries. The using of mediation has a long history in our China, and it is called"the flower of east". But this beautiful"folwer"is blossoming brilliantly in many western countries now, appeared a trend of"students studied from teachers but beyond the teachers". In our country, the mediation system has a diverse character, non-governmental organizations, administrative and judicial departments are devoting into the mediation practice. The theme of this article is how to develop and perfect the mediation system.This article is composed of four chapters. The first discussed the rationality of mediation and its advantage compared with litigation and arbitrition. The second introduced the mediation system of Amercia, Japan and other countries and parties, analysed their characters. The third analysed the mediation system of our country, expounded its disadvantages. The fourth discussed the way of reformation and perfection about nongovernmental, administration and judical mediation respectively.
