Folklore Exploration Of Copyright Protection

With the development of the knowledge and technologic period, the value of the folklore has been engrossed in seriously. The issue on the abuse and the interest conflict has been emphasized by the folklore original group in the utilization process. Besides, the unfair interest allocation rules which have been developed beneath the present intellectual property system are thought, suspected and opposed by the public. As a result, the discussion about the intellectual property of the folklore has been focused on by people.My paper based on this background which is elaborated before, it starts from the quest for justice and the interest of the owner of the folklore, in the sake of seeking for the theoretical basis of the protection of the copyright, more or less, the barriers and the solution of the entities that exist in the rule-making, Based on this I make my effort for the protection of the copyright.In the structure, the details of each chapter are as follows:Chapter 1Through the research of the overview of folk literary and artistic works, I aim at fixing the object and scope of object clearly and accurately.First of all, it talks about the concept of the folklore works. Secondly, about the features of the folklore works. Thirdly, about the folklore works of a similar distinction between the concept and links, so as to establish the folklore of the object furthermore. After the establishment of a range of subjects, I analyze the copyright Protection of folk literature theoretically, Through folklore and public domain works of folk art and literature private property, copyright protection of folklore based public policy options to explore other aspects of copyright protection of folklore theory analysis.Chapter 3After the Protection of objects and theoretical analysis, in this quarter, I talk about how to improve the folklore of the copyright legislation. The former two parts explore the condition of the folk literature of the conservation status of international and domestic in the private level. After it, I analyze the complement of the folklore legislation accurately from the four aspects below:The main legislative proposals of the copyright of the folk literary and artistic works ,the object legislative proposals of the copyright of the folk literary and artistic works, the content legislation proposals of the folk literary and artistic works, and the legislation proposals of the protection time of the folk literary and artistic works. In conclusion, through the definition of the protective scope of the folk literary and artistic works, the reasonable analysis of the protection of it ,the international and domestic condition of the real protection of it, and the complement of the copyright legislative protection.Finally, in short, it forms an essential system for the copyright protection of the folk literary and artistic works.
