With the economic development of China, the prosperity of construction market and the deepening of the construction industrialization, there is a great rise of cases related to the copyright protection of architectural works, which outlines the importance of studying on the copyright protection of the architectural works. However, China's study on copyright issues of the architectural works is still on its preliminary stage overall. There are many theoretical and practical issues related to the problem in need of further study. In this thesis, the writer tries, under the guidance of the principle of the copyright law, with the reference of the international conventions and the legislation of some countries or regions on architectural works, mainly in the method of conceptual analysis, comparative analysis and case analysis, to focus on the definition, rights and protection of architectural works, and attempt to have a better understanding of these issues. After the analysis of the copyright issues related to the architectural works, it is believed that, there are many issues worth discussion in China's existing laws and regulations related to the architectural works. Main points are: First, Chinese law should adopt a broader concept of architectural works, taking architectural drawings, model works and aesthetic buildings included. Secondly, the relevant provisions are too brief. The creation of architectural works is a complex process, so the protection of its copyright involves many issues of specific legal adjustment. In order to protect the copyright of architectural works effectively and to reduce the practical disputes and conflicts arising from that, China should establish the legal system of architectural works that suits the actual conditions of China and the international community.
