Research On The Restriction Of Trade Secrets

As the competition in modern market becoming increasingly fierce, the innovation-based economy is becoming increasingly important,also the voice of protection of intellectual property.Knowledge products as a information got the nature of public, over-protection or even abuse,allow the expansion of proprietary and as a result,the erosion of public welfare.Trade secrets as a special kind of intellectual property, because of its secrecy, relying on the security measures taken by rights holders to maintain its right to exist, easily been infringed, but at the same time will result in information blockade, technology monopoly. Therefore, it is necessary restrict the rights of trade secrets to prevent the abuse of trade secrets, the protection system should up to the required level of incentives, rather than over_high levels which will make adverse affect also hinder social progress.The first part outlines the basic theory of trade secrets, and then analyze the elements and boundaries of trade secrets rights,and the rationality and necessity of restrict, on this basis, followed by anti-trust regulation, labor rights regulation, public interest regulation, legal rights and interests of others.All these are the restrict of trade secrets. Finally, suggestion to improve and cosntruct the restrict system were proposed.
