Organizing and joining trade unions is a basic right of workers as well as a basic prerequisite to the existence and development of the trade union organizations. Therefore to protect the right of workers to form and join trade unions is important in establishing the status of the working class, setting up stable and harmonious labor relations, maintaining workforce stability, and promoting the harmonious development of society.The existing system of China's trade unions is one based on the mode of the supreme representative—All- China Federation of Trade Unions. The right to organize and join trade unions according to law is the right to form and join the National System of All-China Trade Unions. The system is conducive to safeguarding the unity of the trade union organizations but also liable to make trade unions become more or less administrative because of lack of competitions and external pressures. In this sense, workers' rights cannot be effectively protected under current system.In this paper, adhering to the correct political direction and in accordance with relevant provisions of laws and regulations, based on objective reality, the author clearly analyzed and defined the right to form and join trade unions, made in-depth analysis of the current issues and problems on the protection of the right to form and join trade unions at both theoretical level and practical level. Based on the new demand of the Communist Party, trade unions gained new understanding of the their work and put forward multi-perspective, multi- level strategies to cope with new economic and social situations, new workforce changes, and strive to enable workers' right to form and join trade union organizations to be effectively protected.
