| Relative to other violations, environmental pollution caused by inequality against a value, social, complicated and slow and other characteristics, Environmental Liability in tort litigation system and the environment should reflect these characteristics. Environmental Liability in the system is to establish the theoretical basis for environmental rights, environmental rights including the right of individual citizens, the environment and national environmental management. Environmental tort liability system is the core responsibility principle, based on the special nature of environmental tort and environmental tort should be attributable to the original principle of liability without fault. Act on environmental pollution hazards and the damage to determine causal relationship between the results, should be implemented presumptive causality. The environmental tort litigation system, the civil litigation system in China can not meet the current special requirements of environmental tort, this should be the establishment of environmental public interest litigation system. |
