Analysis Of Law Amendment And Standardization

Law amendment is one of the manifestations of legislative activity. Nowadays, social relations are changing constantly with the rapid development of the economy. To adapt to social changes and play its due role in the regulation and protection, the law therefor shall be adjusted accordingly. And such adjustment is usually achieved through law amendments. In recent years, law amendments increased significantly in China. However, legislature's lack of standardization and academic circle's indifference in the study of the basic theory of legal law amendments, directly or indirectly cause the common non-standard phenomenon during law amendments, which indicates that law amendment is the weak link in legislation. In view of this, the paper keeps a foothold in the current legislative practice in China, studies on the existing problems of law amendment by classification based on the analysis of law amendment and its relevant concept, so as to find out the reasons which the problems arising from. This paper gives its opinion in respect of the problems in the main-body and procedure of law amendment, as well as when and how to carry out law amendments.
