Study On The Victims' Rights Protection In Public Prosecution Case

Punishing crimes is the main target of the criminal procedure in China, either legislation or judicial practice; all emphasize prosecution crimes and maintaining public interests, so the personal interests of victims are completely replaced by the national interest. With the victim's rights movement rising and development of the right, how to protection the victim's right in criminal procedure, especially in the public prosecution case, has become one of the hot issues concerned in current theory and practice.As the direct victim of crime, whose right was infringed by criminal, such as personal injury, property losses and life safety. Victims not only suffered varying degrees of economic losses, but also inherit tremendous spiritual pain. Especially victims in the public prosecution case, they are suffered more infringement than victims in the case of private prosecution, behoove to deserve more attention and protection. This article based on the main conception of victims'protection idea, such as humanism, procedural justice, harm banned, compensation justice, through investigating victims'rights protection in public prosecution case in overseas legislation and international standards, in order to promote the legislation of victims'rights protection in public prosecution.
